Justices’ Rulings Advance Gays; Women Less So

Justice Kennedy sounds like a dumbass. In recent Supreme Court rulings that empowered gay Americans, Anthony Kennedy sided with the progressive majority. In recent rulings that shit on women’s rights, and attempt to police their bodies, Kennedy sided with the conservative men of the Court.

With quotes from Ruth Bader Ginsburg, legal scholars, and Supreme Court decisions, this story explores the curious trend of the Court: its expanding the rights of gays while limiting the freedom of women. Justice Ginsburg’s contempt for her less enlightened colleagues is pretty great. Adam Liptak of the New York Times:

Gay men and lesbians still have a long way to go before they achieve the formal legal equality that women have long enjoyed. But they have made stunning progress at the Supreme Court over the last decade, gaining legal protection for sexual intimacy and unconventional families with stirring language unimaginable a generation ago.

At the same time, legal scholars say, the court has delivered blows to women’s groups in cases involving equal pay, medical leave, abortion and contraception, culminating in a furious dissent last month from the court’s three female members.
